On 7 November 2023 a Malaysian politician was acquitted by the Sessions Court in Kuala Lumpur from the charge of spreading fake news, regarding facts occurred in 2021 during the COVID-19 pandemic.

The man, in 2021, has been accused of having used his official account on Facebook to complain about the alleged arrival of Indian nationals, who were identified by him as the responsible for the spread of COVID-19. He was then subsequently charged pursuant to the Emergency Ordinance no. 2 of 2021. However, the court noted, the prosecution had failed in establishing a prima facie case. Indeed, also the prosecution’s witness noted that none of the statements made by the man were factually untrue.

Therefore, the court acquitted the man.
