A recent ruling by the Social Chamber of the Catalan High Court recognized a worker an additional compensation for an unfair dismissal beyond the legally established compensation. It is the first time in Spain that such compensation has been granted based on personal and individualized circumstances. 

The case concerns a woman working for a company in the business of mobility and international relocation of workers and their families, whose dismissal was caused by the cancellation or postponement of the company's services due to the COVID-19 crisis. The dismissal was made on the same day as the approval of the Royal Decree 9/2020, which regulated the so-called prohibition of dismissals. The court recognized the existence of exceptional and personalized circumstances that prevented the worker from accessing unemployment benefits and awarded the worker an additional compensation. The ruling highlights the need to consider individual circumstances in determining compensation beyond the legally established maximum limits.
