As reported in our story of 5 October 2022, the High Court of Justice of the Valencian Community had rejected the appeal of the Valencian government and upheld an Alicante court decision of 13 January 2022 finding that it had violated the fundamental rights of private practice physicians during the COVID-19 vaccination campaign.
Private practice physicians – both self-employed and employees in hospital groups in the province of Alicante – were indeed missing in the vaccination calendar put in place for healthcare professionals by the health authorities. The High Court of Justice of the Valencian Community had held that the authorities had infringed the applicants’ right to equality, to life, and to health.
As the time limit to appeal that decision passed without the Valencian government challenging that decision, it is now exposed to potential compensation claims for around €1.6 million to 400 affected professionals. Each professional could potentially claim around €4,000 compensation.
