On 29 June 2022 (reported on 30 August 2022), the Commercial Court n°1 of Alicante held that Thai Airways had to pay a passenger €611.11 for the reimbursement of a return ticket from London to Bangkok in April 2020, since she could not travel because of lockdown measures imposed at the outset of the COVID-19 pandemic.

While the passenger was entitled to a full reimbursement under the applicable regulatory framework, the airline ignored her requests without justification and acted recklessly and in bad faith, according to the court. Especially due to the economic imbalance between the parties, the court considered that “imposing onerous obstacles to the fulfillment of legal duties was also a bad faith conduct”. Because of the airline’s conduct, the court also decided to make them pay litigation costs.
