On 13 May 2022, the District Court of California rejected a motion to dismiss a complaint filed by ticket purchasers concerning the refund policy for events affected by the COVID-19 pandemic enacted by StubHub, a ticket exchange and resale company.
The plaintiffs allege that StubHub misrepresented its refund policy. Notably, for years prior to COVID-19, defendant had assured customers that ticket purchasers would receive full refunds for cancelled events. However, in March 2020, in light of the COVID-19 pandemic, the defendant announced that instead of a refund, it would issue a 120% credit when an event was cancelled. The court found that the plaintiffs had sufficiently substantiated their claims as to the ticket seller's deceptive attitude.
