On 18 April 2022, Labor Court n°4 of Córdoba ruled that the dismissal of a pharmacy assistant who went to work with COVID-19 symptoms for ten days was justified.
Despite its symptoms, the employee kept coming to work between 21 and 31 December 2020, in breach of the health protocol in place at the time, and when there were no vaccines yet. During his sick leave, the employee did not hand over the pharmacy’s keys to those in charge. Although the employee claimed that he had been harassed to leave the workplace with sanction of dismissal, the court found no harassment and no breach of fundamental rights. As a consequence of the court finding the dismissal to be justified, the employee lost the compensation he would have been entitled to after 30 years of working for the pharmacy.
