On 8 February 2022, the German Federal Court of Justice (Criminal Senate) confirmed a judgment of the lower court, finding that the City of Cologne had lawfully adopted an ordinance imposing the wearing of face masks in its old town, in places with high public traffic (in accordance with the Corona Protection Ordinance of the State of North Rhine-Westphalia of 30 November 2020). The Court found no violation of constitutional law.

The case arose after a claimant had been deprived of liberty after refusing to wear a face mask in Cologne’s city center, and heavily resisting to the police forces. The claimant had been detained until the end of the demonstration against government measures, she was participating in.
