By a one-page interim order of 1 March 2022, a judge of the Supreme Court of New York stated that the mandate was “arbitrary, capricious and unreasonable” and declared the mandate void and unenforceable.

On 4 March 2022, the Mayor of New York city lifted the mask requirement at school for children under twelve. However, he decided to keep the mandate in place for children under five because they are ineligible for vaccination. Several groups of parents challenged the mask mandate, alleging that it was unnecessary because of the low risk of infection for children under five. They argued that the mandate was unconstitutional and that it was damaging to the emotional and social development of young children, who are in the most formative years of their lives.
