On 30 March 2022, the Court of First Instance of Hong Kong rejected the appeal of a claimant opposed to the vaccination program, which was introduced in February 2022 for access to a series of premises including courts, restaurants, supermarkets. 

The applicant, who was not vaccinated, had claimed that the introduction of the vaccination pass violated her fundamental rights related to the possibility of obtaining food, the loss of job opportunities, the violation of the right of defense since she was also prevented from attending court hearings.

However, the court held that the applicant did not provide any adequate reasons for the appeal, and that the emergency legislation introduced in Hong Kong stroke a balance of interests between individual rights and public needs, considering that the lack of access to wet markets did not represent a violation of fundamental rights.
