Medical mask, Covid vaccine and passport

With an interim decision of 14.12.2021, the High Court of Kenya suspended a regulation issued by the Ministry of Health in November 2021, according to which, from 21.12.2021, anyone seeking government services would require to provide evidence of full Covid-19 vaccination.

The case was filed by a businessman who argued that the restriction complained of amounted to a gross violation of the Constitution. The vaccine requirement rule would affect access to public transportation, education, immigration, hospitals, national parks, hotels, and restaurants as well as prison visits. The Court suspended the government’s order until a hearing is held. The hearing should be scheduled in January 2022.
