With a judgment of 7.12.2021, the Supreme Court of Argentina dismissed an appeal filed by a plaintiff who had requested that the extraordinary appeal filed by his counterparty be declared time-barred.

In the applicant’s view, the counterparty’s failure to carry out any procedural activity for nine months was in breach of Article 310 of the Code of Civil and Commercial Procedure of the Nation, which set a three-month time-limit for pursuing the case before the competent Court. The Court held that, given the extraordinary measures taken because of the pandemic, which also affected the functioning of the judiciary, the time-limits were suspended.
